Rochester DWI Charges Explained

4th Degree DWI (Misdemeanor)

Typically, a first offense with no aggravating factors. The maximum penalty is 90 days in jail and/or a $1,000 fine

3rd Degree DWI (Gross Misdemeanor)

One aggravating factor (like 0.16+ BAC). Mandatory jail time may apply. The maximum penalty is 364 days in jail and/or a $3,000 fine

2nd Degree DWI (Gross Misdemeanor)

Two or more aggravating factors. Mandatory jail time and vehicle forfeiture apply. The maximum penalty is 364 days in jail and/or a $3,000 fine

1st Degree DWI (Felony)

Three prior offenses in 10 years or a prior felony DWI. The penalty is a potential prison sentence of up to 7 years.
